New 2/7/13 Lorain County Township Association Members killed the proposal for the County Run Building Department. The Lorain County Township Association has agreed to set up their own Building Department on a voluntary operation.
New 1/23/13  Two Lorain County Commissioners, (2 Democrats), want to resurrect the Lorain County Building Department making it full time and Making it Mandatory County Wide for the Townships to Join! This means that it will cost you the CITIZEN EXTRA MONEY to do home improvements because you'll need a PERMIT & INSPECTIONS from the COUNTY. Permits will be from several hundred dollars to thousands of dollars. Annual budget for this operation will be about $200,000 to begin with.
Public Meeting will be held Feburary 6th at the County Administration Meeting Room at 6pm & February 13th at 9am, County Administration Meeting Room.

Response to some of the comments below:
The Zoning Inspector or Trustees have not issued a permit for this lagoon or rezoned the property. We have a legal responsibility to enforce the zoning regulations and have to do that in a legal way though the courts-not a fast process. As you know this has happen though the holidays which has delayed any responses.

Phone numbers for all township trustees are posted on the Who's Who at Pittsfield Township and on all Newsletters.   We do have a answer system on the phone at the town hall but has malfunctioned when the phone lines were cut in November. Also due the high volume of calls it has become filled and won't answer.

The Town Hall Meeting is sponsored by the residents, not the trustees or Quasar. My intent was not to mislead anyone or imply that the trustees are not supported of this meeting.

02-06-13 Answer to Katherine-I don't know where you got your information from but Erik  A. Breunig DOES NOT Practice or Specialize in Much Family Law! Please do more research. Steve Magyar, Trustee

02-04-13 Trustees,  did you ask for the NEW attorney's credentials when you went into a private session? Mr. Bruenig specializes in FAMILY law, not zoning. What were you thinking? I have a feeling we're going to get our hats handed to us in court.
Katherine

01-26-13 1). Indeed, when Mark & Dan visited this lagoon why did they allow it to continue? Can you please tell us your reasoning behind that?  2).Why did you not do your job, is it because you don't really know what your job is, or was it just plain negligence? Either way, maybe it's time for a change.  We want to thank everyone who has come on board to help stop this lagoon, our numbers continue to grow.  As you know we want the entire population of Pittsfield Township and surrounding communities to join us in our battle. We are still finding people that haven't heard about the lagoon or don't realize there could be more coming.  90% of the people we talk to join us.  Please continue to spread the word.  3) Lastly, to the trustees/prosecutor we fully expect this lagoon to get stopped permanently.  This can happen if you take the necessary steps.  Our health is at risk, our property values are at risk.  We hold you responsible.

Answer to your questions above: 1). When we found about the lagoon it was all ready completed, Dan & Mark then met with Quasar and ask what the lagoon/pond was going to be used for. After the fact finding on December 3, 2012 it was turned over the prosecutor who had to research Ohio law to determine if it lawful or not. After it was determined it was industrial the trustees met and directed the zoning inspector to issue a stop order, then a stop order was issued.
3).We the trustees will peruse this in zoning appeals or court and the zoning appeals/court or judge will decide the fait of this lagoon. There are laws that we must abide by as well as Quasar.
       2) and part of 3). We spent about $30,000 in 2001/2002 to update our zoning and spent over a year on it. We feel it is pretty good at this point and that this industry is not allowed in the township. There always will be someone that will challenge that.  We will always answer that challenge legally. We ask you,  what else would you like us to do?

Your response is appreciated.  However, I seen nothing about tweaking your regs., if this is not done I fear the worst.  This is big money we are up against.  They will find a loophole if one exists.  I can't stress to you enough how we feel.  We are urging people stay calm, but we want to see more actions taken.  Don't let us down.

WE ASK OUR TRUSTEES TO STEP UP TO THE PLATE, GET AGGRESSIVE, AND RELIEVE US RESIDENTS FROM ANY COSTS OF FIGHTING THIS LAGOON. WE ARE PREPARED TO PUSH ONWARD, BUT DO THE RIGHT THING AND NOT MAKE US INCURR ANY MORE COSTS.  MANY, MANY RESIDENTS ARE WATCHING HOW THIS IS HANDLED.  JOHN

01-22-13
THE RESIDENTS OF PITTSFIELD TOWNSHIP FULLY EXPECT THE TRUSTEES AND ASST. PROSECUTOR TO GET THE REGULATIONS IN PLACE TO PUT A PERMANATE STOP TO THIS LAGOON.  IF FOR SOME REASON THIS LAGOON GET IN PITTSFIELD TOWNSHIP THE RESIDENTS ARE PREPARED TO TAKE FURTHER ACTION.  CONCERNED AND SERIOUS.

This is an outrage, atrocity, and unconscionable.. the land is zoned agriculture.  The sludge is feces, human. Our zoning laws say, no human feces, and no commercial on ag land.  Why isnt this sopped NOW.  Dan shinsky  doesn't need anything to stop it except his word.   We watched th is parcel for 7 years before we purchased one year ago and now
We are devastated that our collective 90 years of work is going to smell feces . We cant even move from our house and sell.  Family says they  will never visit.  This area  will be destroyed.  If it happens here, french creek will be putting it in all over lorain county.. when dan and mark visited the site, why didnt they stop it then.. did you know that the legal notice was put in the chronicle on christmas day.. this operation has been deceitful from the beginning, leading us on hughes and quarry to believe, he was tiling his farm field.  We are asking the trustees to help their community.  Stop it  today! Please!  Jenn
How can this be set to take place.  I thought you were against this as Trustees?
Joyce
Please correct the flyer, township hall meeting  info.. this IS NOT sponsored by quarry and hughes rd residents, but the entire pittsfield population..we are disheartened that our trustees are not enforcing the zoning laws..  all this can be avoided by enforcement of the laws.  Were the zoning laws changed? Was the parcel zoning changed?  Do the trustees  not care about how their residents live and next to what?  What are you going to do about the damage to our property line by this company and finding cameras and deer stands with ladders on  our trees.  This never happened before the entire fence that crosses 4 parcels was torn down.. because  there was no way to get back there with all that equip, except for the truck traffic that was back there all summer and fall, that entered from  quarry.
By the way, a blog is not to be deleted, but for everyone's opinions so we can as a community move forward in a peaceful manner by enforcing our laws.. simple as that. Thanks.  And happy new year, hope we have great news wednesday, we r hoping u come through for us and are trusting  you!  Jenn
Please post phone numbers for contact of Dan Shinsky and  Mark McConnell on the website.. there have been several occasions where we needed to call and no  numbers that will answer.  The twp hall doesn't have msg capability.  We had to call the sheriff twice this summer due to suspicious activity on our back property re ortner property activity.   Also, we need those numbers in case we see activity on our project in question as directed by  Trustee Mark McConnell.  WE called the hall last nov., when we moved in, Dan answered and told us to hang up and call back. We called back and there was NO answer!
Thanks  Dave and Jenn

Dear Fellow Residents, Please get informed about what has been put in On Quarry Road.  A class B sewage storage lagoon.  The waste that is planned to get put into this whole is treated with chemicals, which helps kill disease that is present in human waste, however the chemicals only kill so much, not everything. Because the whole of waste will not be covered, when the sludge drys, the wind then takes chemicals and disease that hasn't been killed airborn.  Making this site affect all of our health that live in the Pittsfield Township area. Please make an effort to come to the meeting Wednesday evening at 7. We are coming together to make a plan of action to protect our beautiful township and the health of our families from a garbage whole of class B sewage. We must take a stand! This land is zoned agricultural and residential. The operation that is going to take place is industrial per the epa. Zoning laws exist to protect residence. These need to be enforced and our Township has the authority to do so! I am still holding out hope in the trustees on our board! Respectfully, Rachel and Joe , Hughes Rd. resident

My name is Linda Harris.  I presently reside on the 97 original acres of farmland that was my homestead and property farmed by my late father Warren Harris and mother Helen Harris.  The acreage south of my property was originally owned by charles Carter and then sold and now the proposed site of a "industrial" sewage storage pit or "lagoon".  I have struggled to afford to maintain my farm and enjoy the lifestyle which I have been so accustomed to.  I am sickend by the thought of having a storage unit that contains human waste, processed or not, existing in close proximity to my home.  I am worried that there will be encroachments or seepage onto my farm acreage and possible contamination of my soil and pond.  I think this open air lagoon will be a insect haven and thus creating another health concern.  I am also convinced that if this is such a safe product then why isn't the city of n. ridgeville or adjacent areas taking advantage of yet another benefit from Quesar and put a lagoon on their properties?
I have read about the benefits that N. Ridgeville is getting however what are we getting?  A smelly, potentially hazardous crap pit and the devaluation of our properties in Pittsfield Twp.  Shouldn't we be considered for a tax break also?
I truly believe that this could be the start of an epidemic in this entire County and State.  Country living will no longer be as we have known or know it now.  If this lagoon is approved, no one is safe from the intrusion of future structures.   If this company can convince farmers that this is a great product with plenty of "nutrients" without any documentations as to the contents actually present in the "sludge" and testimonials to support their claims then they will be successful in their efforts to claim more residential prime farmland.
I am totally opposed and insulted to think that Quesar initiated its project with disregard to the rules of zoning and laws regarding wetlands, etc.   I will be proactive with this entire community to proceed with any legal battles in the attempt to save us from the health issues that may impact our lifestyle greatly and to protect our community from future such undesirable projects.
Sincerely,
Linda Harris

The meeting tonight was informative, but i truly think it should have never gotten this far. Having said that, we now have to take a different approach.  I wonder if anyone  could come up  with another way to deal with this stuff, because this approach will surely invite much more serious health issues that  have already been plaguing our country, however, the  v large corp will deny.
Here is my concern tonight:  I received some information regarding Forrest City in Wellington, that they already have an agreement that they are going to  dump their raw 'whatever' at the quarry site.  DOes this mean that infact this IS going to be a waste water treatment plant??????   Given that information, i think that entire 60 acres is a gonner.Unbelievable that our beautiful farmland that grows such beautiful green stuff can turn into a fecal pit, stench, disease ridden, destroy livlihoods and family life.  The EPA guidelines  specify that no person living on their property should be infringed upon with stench, increased insects, rats, as well as denied the right to enjoy their property with clean air and water.    There is NO way that French Creek will control those issues, they plain DONTcare,  if they did CARE, the  sludge wouldn't be there and they would be pursuing a way to deal  with  the sewage waste class B in a people /environment  friendly way, rather dump it on your neighbors property.  This is as low as anything gets!  Jenn
Interesting that many people that are being directly effected by this Quarry Road septic pool are public servants, nurses, police officers, firemen, public advocates, etc..and we get dumped on in our elder years. Unconscionable!!
my fear as a health advocate is the people in the near proximity for health and putrid odors, now that I know that this company is incredibly lax in their EPA guidelines,  little to no odor control,  little to no spillage control, , but also those in the 3 - 5 mile radius!! I can tell you that yellow fever and malaria are carried by the mosquitoes. It was responsible for shutting down the panama canal many times until it was discovered and locals were vaccinated, killed thousands.  as well as the american frontier, many died from improper sewage: hence the plague 1890-1905 hit US cities and countryside and Indian encampments.  The source?? Raw sewage open to the Air.... When will they learn??? Jenn ...need citations or references for good history read of sewage and plagues of yellow fever and malaria.  call me  419-706-9233.
